Data Protection

In today’s data-driven world, safeguarding personal information is crucial. Considering that in Europe, data protection is a fundamental human right and since the implementation of the General Data Protection Regulation (“GDPR”) (EU Reg. 2016/679) in 2018, the GDPR has brought data protection to the forefront. The GDPR mandates stricter reporting duties for data breaches (i.e., unauthorised access, loss, alteration, or disclosure of personal data). This regulation has significantly altered how personal data is managed, imposing notable responsibilities on companies handling such data and making them accountable for all processing activities. Therefore, it ensures that data processing has a lawful basis, respects individuals’ privacy rights, and limits data retention to necessary periods. Non-compliance can result in substantial penalties for organisations.

Notably, the GDPR extends its reach beyond EU borders, as it governs the transfer of personal data to non-EU countries. In such instances, the European Commission is in charge of assessing the level of protection afforded by a territory or processing sector in a non-EU country. It thus, assesses reasonableness or requires appropriate safeguards for such transfers, ensuring continuity of protection for individuals’ data privacy rights. Enforcement of GDPR falls under the purview of the European Data Protection Board. This oversight allows individuals to file complaints to the Data Protection Commissioner within 72 hours if a data breach occurs and pursue legal remedies.
