Public Registry kept by ESMA relating to EMIR

On the 6th September 2022, the Malta Financial Services Authority (“MFSA”) issued a circular on Article 6 of the European Market Infrastructure Regulation (“EMIR”) which states the following:

ESMA shall establish, maintain and keep up to date a public register in order to identify the classes of OTC derivatives subject to the clearing obligation correctly and unequivocally. The public register shall be available on ESMA’s website.”

In the Circular, the MFSA remarks that ESMA has updated its register on the 6th of September 2022 which can be accessed from here. The circular is aimed at all market participants, in particular at those entities who enter into derivative contracts, financial counterparties, and non-financial counterparties as defined by EMIR.
